TERMS & CONDITIONS OF PURCHASE & ATTENDANCE
Builder Elite Pty Ltd
By purchasing a ticket to, registering for, and/or attending Built Mastery (“the Event”), you acknowledge and agree to the following Terms & Conditions in their entirety. Agreement to these Terms is a condition of purchase and entry.
1. EDUCATIONAL PURPOSES ONLY
The information presented at the Event is strictly for educational purposes. Nothing presented constitutes, or is intended to replace, legal, financial, accounting, taxation or medical advice. You are advised to obtain advice specific to your circumstances from appropriately qualified professionals before acting on anything presented at the Event.
You acknowledge that the primary presenter, George Passas, is not a financial planner, financial adviser, registered accountant, medical practitioner or legal adviser. The information presented is based on the speakers’ personal experience as entrepreneurs, builders, educators, consultants, coaches and investors, and you may need to adapt, modify or further research any concepts to suit your own personal and business circumstances.
2. NO GUARANTEE OF RESULTS
Builder Elite Pty Ltd makes no representation, warranty or guarantee as to any business, financial or personal results you may achieve from attending the Event. Any examples, case studies or figures presented are illustrations only and are not a promise of performance. Your results depend on factors outside our control, including your own actions, implementation, business circumstances and market conditions.
3. TICKETS & PAYMENT
(a) Your ticket entitles you to attend the Event for the dates and location specified at the time of purchase. Ticket prices are as published or as offered at the time of purchase and are in Australian dollars, inclusive of GST unless stated otherwise.
(b) Full payment (or, where a payment plan is offered, the first instalment) must be received before your registration is confirmed. Builder Elite Pty Ltd reserves the right to cancel any registration that remains unpaid.
(c) Where you purchase on a payment plan, all instalments must be paid by their due dates, and the full ticket price must be received by Builder Elite Pty Ltd before the first day of the Event. Entry to the Event will not be granted unless payment has been received in full. If an instalment is not paid when due and remains unpaid after reasonable notice, Builder Elite Pty Ltd may suspend or cancel your registration, and any amounts already paid will be handled in accordance with Section 4.
(d) Your ticket is for your personal attendance only and may not be on-sold, advertised for resale, or used for any commercial purpose. Tickets may be transferred to another person only in accordance with Section 4(c).
(e) Any promotional pricing, bonuses or inclusions offered at the time of purchase (including offers made at a Builder Elite event) apply only to the terms stated at the time of the offer.
4. CANCELLATIONS, REFUNDS & TRANSFERS
(a) Change of mind. Tickets are non-refundable for change of mind, to the extent permitted by law. If you notify Builder Elite Pty Ltd in writing more than 30 days before the first day of the Event that you are unable to attend, you may elect to transfer your ticket to the next scheduled Built Mastery event at no additional cost.
(b) Late cancellation. If you notify us within 30 days of the first day of the Event, or fail to attend without notice, no refund or transfer applies, and any unpaid instalments remain payable.
(c) Transfer to another person. You may transfer your ticket to another person by written request to Builder Elite Pty Ltd at least 7 days before the first day of the Event. The incoming attendee must accept these Terms before entry.
(d) If we cancel. If Builder Elite Pty Ltd cancels the Event and does not reschedule it, you will be entitled, at your election, to a full refund of amounts paid or a credit toward a future Builder Elite event.
(e) If we postpone or relocate. If the Event is postponed or moved, your ticket will automatically apply to the rescheduled event. If you are unable to attend the rescheduled date, you may request a transfer to a later Builder Elite event or, where required by law, a refund.
(f) Builder Elite Pty Ltd is not responsible for any travel, accommodation or other costs you incur in connection with the Event, including where the Event is changed, postponed or cancelled. We recommend you consider travel insurance.
(g) Nothing in this Section limits your rights under the Australian Consumer Law.
5. EVENT CHANGES
Builder Elite Pty Ltd reserves the right to vary the program, speakers, format, venue or schedule of the Event where reasonably necessary. Changes of this kind do not entitle you to a refund, provided the Event remains substantially the same as advertised.
6. ENTRY, CONDUCT & REMOVAL
(a) Builder Elite Pty Ltd reserves the right to refuse entry to, or remove from the Event, any person at its discretion, including for disruptive, offensive or inappropriate behaviour, or for breach of these Terms. If asked by a Builder Elite Pty Ltd representative to leave the Event, you agree to do so immediately. Removal for breach of these Terms does not entitle you to a refund.
(b) You agree to conduct yourself professionally and respectfully toward all attendees, speakers, staff and venue personnel.
(c) You must not solicit, promote or sell your own (or any third party’s) products or services to other attendees at the Event without the prior written consent of Builder Elite Pty Ltd.
7. VENUE RULES
You agree to comply with all reasonable rules, directions and requirements of the Event venue and its staff, including in relation to safety, security and emergency procedures.
8. GUEST SPEAKERS
The Event may feature guest speakers and presenters who are not employees or representatives of Builder Elite Pty Ltd. The views, opinions, information and any offers made by guest speakers are their own. Builder Elite Pty Ltd does not endorse, warrant or accept responsibility for any advice, product or service offered by a guest speaker, and any dealings you have with a guest speaker are solely between you and that speaker.
9. OFFERS MADE AT THE EVENT
Builder Elite Pty Ltd may present offers for its programs, events or services during the Event (including the Boardroom program and other Builder Elite programs). Any such offers, including pricing, bonuses and inclusions, are available only on the terms stated at the time the offer is made, may be time-limited or limited in number, and are subject to their own separate terms and conditions. Builder Elite Pty Ltd is under no obligation to extend or repeat any offer after the stated offer period has ended.
10. INTELLECTUAL PROPERTY
All Event content — including presentations, slides, workbooks, manuals, handouts and any other materials — is protected by intellectual property laws, including copyright and trademark laws, and remains the property of Builder Elite Pty Ltd (or the relevant rights holder). You must not record, transmit, reproduce or distribute the whole or any part of the Event or its materials without prior written permission from Builder Elite Pty Ltd.
Workbooks and materials provided to you are for use in your own business only. You must not share, reproduce, publish or distribute them, or use them to deliver training, coaching or educational services to any other person or business.
You must not bring recording devices or cameras into the Event, or record or photograph any part of the Event, without prior written permission. Unauthorised recording is grounds for removal from the Event, and you agree to delete any unauthorised recordings upon request.
11. EVENT RECORDING & MEDIA RELEASE
You acknowledge that the Event may be recorded by Builder Elite Pty Ltd via photography, video and audio, and that these recordings remain the sole property of Builder Elite Pty Ltd. By attending, you consent to your image, voice and likeness appearing in such recordings, and to Builder Elite Pty Ltd using them for marketing, promotional, educational and training purposes across any media, without payment or further approval.
If you provide a testimonial (written, video or audio), you consent to Builder Elite Pty Ltd publishing that testimonial, together with your name and relevant biographical details, in its marketing and promotional materials.
If you do not wish to be featured in event photography or video, please notify the Builder Elite Pty Ltd event team in writing prior to or at the Event, and we will take reasonable steps to accommodate your request.
12. CONFIDENTIALITY
During the Event, you and other attendees may share information about your respective businesses. You agree to keep confidential any business, financial or personal information shared by other attendees during the Event, and not to use that information for any purpose other than your participation in the Event.
13. PRIVACY
Builder Elite Pty Ltd collects and handles your personal information (such as your name, contact details, business details and payment details) in accordance with the Privacy Act 1988 (Cth) and its Privacy Policy. Payment information is processed securely via our third-party payment providers. Your information may be used to administer the Event, communicate with you about the Event, and inform you about other Builder Elite Pty Ltd programs, events and services. You may opt out of marketing communications at any time. A copy of our Privacy Policy is available on request or via our website.
14. ASSUMPTION OF RISK & PARTICIPATION
You attend the Event of your own free will and at your own risk. Participation in any Event activities, exercises or workshops is strictly voluntary. You are responsible for assessing your own fitness and suitability to participate in any activity, and you assume the risks associated with your participation.
15. PERSONAL PROPERTY
You are responsible for your own personal belongings at all times during the Event. To the maximum extent permitted by law, neither Builder Elite Pty Ltd nor the Event venue accepts any responsibility for the loss, theft of, or damage to, any personal property brought to the Event.
16. FORCE MAJEURE
Builder Elite Pty Ltd will not be liable for any failure or delay in staging the Event, or any change to the Event, caused by circumstances beyond its reasonable control, including (without limitation) venue unavailability or failure, fire, flood, natural disaster, epidemic or pandemic, government direction or restriction, industrial action, or failure of utilities or transport. In such circumstances, Builder Elite Pty Ltd may postpone, relocate or cancel the Event, and the remedies set out in Sections 4(d) and 4(e) will apply.
17. LIABILITY
To the maximum extent permitted by law, Builder Elite Pty Ltd, George Passas, and their respective employees, directors, contractors, agents, speakers and representatives exclude all liability for any loss, damage, cost or expense (including loss of profits, business interruption, or indirect or consequential loss) suffered or incurred by you in connection with your attendance at, or reliance on any information presented at, the Event.
Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified. Where liability cannot be excluded but can be limited, Builder Elite Pty Ltd limits its liability, at its election, to resupplying the relevant services or paying the cost of resupply.
18. GENERAL
(a) These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.
(b) If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.
19. ACCEPTANCE
By ticking the acceptance box during purchase or registration, you confirm that you have read and understood these Terms & Conditions and agree to be bound by them. Your purchase, registration and attendance constitute your acceptance of these Terms.
